A judge might intervene if a jury was not looking at the crime without considering these circumstances. They are not related in legal terms.

I sure would find him guilty. We don’t need to start normalizing vigilante Justice unless you plan on making that ok on a broader scale and let the courts decide if the wrong was enough to warrant killing the other guy. Such a precedent would be pretty ugly in its execution.

You guys seem to be saying if it’s some extreme thing somebody is doing like the accusation here it should automatically be A-ok to go shoot and kill the person. Because that is the exact precedent that would be set.

Read my post carefully. I said there are extreme circumstances where I might be willing to look the other way when vigilante justice is carried out. I'm not saying it should be codified or legalized, nor am I necessarily suggesting this sheriff shouldn't be prosecuted. What I'm saying is that when that jury ends up in a deliberation room, if I'm on that jury, I might be arguing that this is one of those rare instances where justice has ultimately already prevailed and throwing this guy in prison would be counter-productive towards the end of achieving justice.

But the legal system runs on precedents so it opens the door for someone to do this same thing and possibly get off with the lawyers coring this case. We simply don’t do this in the United States. Period. You might feel that way but if you are on a jury your feelings are irrelevant. You’re supposed to go where the facts take you.
