What’s really happening here is right wing media and Trumps lackeys like Ku Klux Karoline are just calling him an illegal and entirely ignoring his protected status so you’re exactly right. They are trying to move perceptions of this guy. Frankly this seems like a hell of a lot of trouble on their part for a small fish.
It also occurs to me that complaints from them about unethical behavior or wife beating or whatever the fuck are so hypocritical as to be absolutely absurd. These people wrote the book on such bad behaviors.

A federal appeals court on Thursday excoriated the Trump administration for its conduct in the case of Kilmar Abrego Garcia, the man who was wrongly deported from Maryland to a notorious prison in El Salvador.
The administration is “asserting a right to stash away residents of this country in foreign prisons without the semblance of due process that is the foundation of our constitutional order,” wrote Judge J. Harvie Wilkinson in an opinion for a panel of the 4th Circuit Court of Appeals.
“Further, it claims in essence that because it has rid itself of custody that there is nothing that can be done,” he wrote. “This should be shocking not only to judges, but to the intuitive sense of liberty that Americans far removed from courthouses still hold dear.”
Wilkinson, a Reagan appointee who has been on the bench for 41 years, is one of the nation’s most prominent conservative appellate judges. His seven-page opinion is the latest — and most scorching — judicial rebuke of the Trump administration’s aggressive moves to sidestep court orders in high-profile immigration cases.
Earlier this week, U.S. District Judge James Boasberg found probable cause to hold administration officials in contempt for defying an order to halt deportations of people deemed “alien enemies.” And U.S. District Judge Paula Xinis scolded the administration for having done “nothing” to comply with her order to facilitate Abrego Garcia’s release from El Salvador.
Wilkinson and the two other judges on the 4th Circuit panel rejected the administration’s appeal of an April 10 order from Xinis directing the administration to “take all available steps” to facilitate Abrego Garcia’s return to the U.S. “as soon as possible.”
Wilkinson zeroed in on the Justice Department’s admission that it had “mistakenly” deported Abrego Garcia.
“Why then should it not make what was wrong, right?” Wilkinson wrote.
Abrego Garcia was detained and quickly flown to El Salvador last month despite a 2019 court order that barred the government from deporting him there because of the risk that he could be targeted by a local gang. The Supreme Court said his deportation was “illegal” in a decision upholding Xinis’ directive requiring the U.S. to facilitate his release.
But the administration has apparently taken no concrete steps to bring him back.
Instead, Trump administration officials have claimed they have no power to do so now that he is under the jurisdiction of El Salvador. On Tuesday, Xinis ordered an “intense” two-week inquiry into the administration’s defiance.
Wilkinson warned of a dangerously slippery slope on the horizon. “If today the Executive claims the right to deport without due process and in disregard of court orders, what assurance will there be tomorrow that it will not deport American citizens and then disclaim responsibility to bring them home?” he wrote.
“And what assurance shall there be that the Executive will not train its broad discretionary powers upon its political enemies?”
And he chided the administration broadly for its contemptuous attitude toward the judiciary, noting its calls for the impeachment of judges and “exhortations to disregard” court orders.
In this environment, he wrote, the executive and judiciary branches are coming “too close to grinding irrevocably against one another in a conflict that promises to diminish both. This is a losing proposition all around.”

Here’s a new example this time with an American born citizen sent to an ICE detention center and still held there despite a court hearing and his birth certificate being produced. He has been released after being held for 24 hours.

A U.S.-born American citizen was being detained at the request of immigration authorities Thursday despite an advocate showing his U.S. birth certificate in court and a county judge finding no reason for him to be considered an “illegal alien” who illegally entered Florida.
Juan Carlos Gomez-Lopez, 20, was arrested Thursday evening by Florida Highway Patrol and charged under a state immigration law that has been temporarily blocked since early this month. Details of Gomez-Lopez’s arrest and detention were first reported by the Florida Phoenix news site.
After inspecting his birth certificate, Leon County Judge LaShawn Riggans said during the hearing that “this is indeed an authentic document,” but that she did not have jurisdiction beyond finding no probable cause for the charge.
Immigration and Customs Enforcement’s role is to enforce immigration laws that generally apply to noncitizens. American citizens are protected under the Fourth Amendment of the Constitution from unreasonable search and seizure, arrest and detention.
Nonetheless, he remains detained locally at ICE’s request, said Thomas Kennedy, a spokesperson at the Florida Immigrant Coalition who attended Thursday’s hearing.
“Everything tracks for him being sent to an ICE detention center,” he told NBC News in a phone interview.
NBC News has reached out to state and federal authorities for comment.
Gomez-Lopez was in a vehicle with other passengers and was traveling to work from Georgia when they were stopped after entering Florida.
A sweeping immigration law signed by Gov. Ron DeSantis in 2023 makes it a state crime for an undocumented immigrant over age 18 to enter the state illegally.
Gomez-Lopez was born in Georgia but lived much of his life in Mexico. His first language is Tzotzil, a Mayan language, the Florida Phoenix reported.
His mother burst into tears when she saw her son virtually at his hearing, the news site reported.
“I felt immense helplessness because I couldn’t do anything, and I am desperate to get my son out of there,” she told the Florida Phoenix.
Kennedy compared the situation to Franz Kafka’s novel “The Trial” in which man must defend himself against a charge but has no information about it.
“It’s like this bureaucratic, dystopian nightmare of poorly written laws,” Kennedy said. “We are living in a time when this man could get sent to El Salvador because, what, is he going to be treated like a stateless person?”
Kennedy was referring to the hundreds of immigrants who have been sent by the Trump administration to an El Salvador megaprison after they were accused of being gang members under the wartime Alien Enemies Act. Families, attorneys and some U.S. legislators have not been able to have any contact with them.
On Thursday night, Sen. Chris Van Hollen, D-Md., confirmed he had a meeting in El Salvador with Kilmar Abrego García, a man who had been living in Maryland for several years and who the Trump administration said it mistakenly deported to El Salvador in March. Van Hollen traveled there after Abrego García had not been transported back to the U.S. despite a Supreme Court ruling ordering the Trump administration to “facilitate” his return.
