The FTC ruling becomes effective this September. But at least three lawsuits have already been filed. It's expected at least some of the challenges will be successful, because any final rule in which the FTC claims authority to ban restrictive covenants is not likely to withstand constitutional scrutiny.
Even so it’s not a bad rule. Why should a company be able to control someone’s desire to be employed elsewhere? It’s no different than if the government started doing that. Go to hell is the correct response to that kind of insanity.
The employee agrees to that condition when they get the offer for hire for the company. If no one would have ever accepted that term, then the term would be forever eliminated in the offers.
I hadn’t thought of it like that. What if everybody simply stopped taking it one day?

In this instance it doesn't matter, part of the buyout waives the non-compete clause in the contracts because the company is prematurely ending the employment contract.

Interesting... so they are free to do whatever they want as soon as they are outta there.

Presumably 2 would get anybody that wanted to work in TV rather than 7 or 62. No real anchors in that list which is what 7 does have posted for 5 and 10pm currently.

Just because Mara talked to Fox 2 management doesn't mean there is a job there for her or that she would be willing to work there for the position and pay that they might offer.

Possibly not this one, WDIV may be paying talent NOT to work.
Those types of non-competes are perfectly valid. The ones the FTC went after were the ones where the employer did not pay for the privilege of keeping an employee from working for a competitor, they just required compliance with threats of legal action.

That all goes without saying and literally applies to any job search on earth. I’m just spitballing which one would most likely take somebody if the stars aligned perfectly. The starts could go supernova and none of them see the light of day again too.

They absolutely should get rid of no competes when the company chooses to get rid of you. I always thought that was crazy. I don't want you but you can't go to the competition either for a year.

Just thought I'd chime in on this thread too; I was curious about non-compete clauses here (without knowing any of the legal ins and outs) but it would seem that Tim Pamplin announcing his WWJ radio job has demonstrated that there isn't an issue there.

Mara has Erika Erickson's former role as director of communications for the Wayne County Sheriff. Her statement about the latest round of accusations against Raphael Washington aired on 4 and 7.
