Also, Trump told us that everyone wanted the abortion question to go back to the states, why wouldn't the same be true for immigration? We're talking about protecting actual living people rather than potential people.

There are certain roles designated to the federal government. Two of them being defense and immigration. The federal government is not telling the states they have to take over the task of immigration, but the states (well, just SOME of the states) are actively interfering with the federal government in their attempts to execute their assigned duties.

Actually before the Chinese exclusion act of 1882 there was nobody giving a flying fuck about immigration and worrying about who was coming in and all this blah blah blah… so nothing formally designates the Feds as arbiters of immigration. The constitution doesn’t even have the word in it. Worrying about it is a newer thing.

I read somewhere that everyone knew the judicial system would get involved with this order. Evidently the orange wonder wants the Supreme Court to get it. Thinking is the judges he put in there will carry the day and convince the court that an order that ignores the constitution is ok to carry out.

You hit the nail on the head ZZ… that’s exactly what the hope is. If they say know he could very well pull a “Justice Roberts has his decision now let him enforce it” thing. Since the Supreme Court doesn’t have a police force and relies on folks playing along with its decrees to have any power they can be easily ignored if someone really wanted to push it.
