Cumulus Sues Former WDRQ/Detroit Host Krissy T Over New Job At Online Station
January 5, 2021 at 5:13 AM (PT)

“CUMULUS MEDIA is suing a former host at Country WDRQ (NEW COUNTRY 93.1 FM)/DETROIT and her new employer for violation of her noncompete clause and the terms of a release negotiated by the parties.
CUMULUS subsidiary DETROIT RADIO, LLC filed suit against KRISTINA (KRISSY T) WILLIAMSON and WOODWARD SPORTS NETWORK, LLC in U.S. District Court for the Eastern District of MICHIGAN on DECEMBER 23rd, alleging that WILLIAMSON left the "BROADWAY AND KRISSY IN THE MORNING" show (a/k/a "ELECTRIC BARNYARD WITH BROADWAY AND KRISSY") at WDRQ in NOVEMBER 2020 (NET NEWS 11/10/20) to take a job with the new WOODWARD SPORTS NETWORK as a "brand influencer" on social media.
The suit claims that WILLIAMSON told CUMULUS VP/Market Mgr. STEVE FINATERI that the job with WOODWARD was an off-air position and would not violate her noncompete agreement, and FINATERI responded that he would release her from the noncompete as long as she stayed off-air and did not use her "KRISSY" or "KRISSY T" persona. WILLIAMSON subsequently joined WOODWARD's morning show, "WAKING UP WITH MORNING WOOD WITH JOEY, STICK AND KRISSY," which CUMULUS contends is a competitor to WDRQ's morning show. CUMULUS also says the WDRQ morning show experienced a ratings drop and the loss of an advertiser after WILLIAMSON left and began appearing on the WOODWARD show.
CUMULUS is alleging breach of contract, unfair competition (improper use of service marks), unjust enrichment, and statutory and common law conversion of trade secrets by WILLIAMSON, as well as tortious interference with contract and business relationship/expectation and conspiracy by WILLIAMSON and WOODWARD. The company is looking for monetary damages and an injunction preventing WILLIAMSON from working at WOODWARD in violation of the contract and release.”

So many things wrong with this, but the pricks at Cumulus trying to pull off this stunt because they got butt hurt by an employee wanting to better herself by leaving that sinking ship and going to an on-line sports station is at minimum embarrassing. These A-holes fire folks and ruin lives on the regular without any repercussions other than a severance check and a handshake and they go after her!?

Mr Finateri, that non-compete is toilet paper and you know it. Making her have to lawyer up is a classless move.

Normally, I don't think non-competes hold much water. However, if she got a severance check and the agreement was to stay off the air and not use the persona during that agreed-to period, then she is in violation and either should return the severance or be required to pay damages.

Looks like "WAKING UP WITH MORNING WOOD WITH JOEY, STICK AND KRISSY" was already cancelled. Gone from the site and the podcasts.

Not a chance they can get her name, prior usage is pretty clear. If anyone in Detroit would have that claim, it would have been iHeartMedia, but even they aren't that petty.

As far as the rest of it, I would be putting it in a sales package if I'm WSN, they're a startup and can play the David position versus the Cumulus goliath. 'The Network that put corporate radio on notice!" Cumulus has now admitted that they lost ratings to WSN and the only thing they can do to combat is sue, rather than create compelling content.
