US Supreme Court rules 5-4 in favor of religious freedom during the pandemic

Post by bmw » Thu Nov 26, 2020 9:22 am

In the late-night decision, Barrett sided with her conservative colleagues in the dispute, while Chief Justice John Roberts joined the three liberal justices in dissent...The ruling, released just before midnight on Thanksgiving eve, contains several separate opinions and some unusually critical language.

In the main, unsigned opinion, the majority ruled in favor of the Roman Catholic Diocese of Brooklyn and Agudath Israel of America that argued that the restrictions violated the Free Exercise Clause of the First Amendment because the regulations treated the houses of worship more harshly than comparable secular facilities.

The majority said that the regulations are "far more restrictive than any Covid-related regulations that have previously come before the court, much tighter than those adopted by many other jurisdictions hard hit by the pandemic, and far more severe than has been shown to be required to prevent the spread of the virus" at the religious services in question.

But hey, at least Cuomo won an emmy. :barf

Cuomo must have skipped class the day they were reading constitution.

Of course it also defied common sense.

My question is, is this ruling a sign of things to come?

btw - is it just me, or is Justice Roberts more liberal than was Justice Kennedy?

Roberts didn't write the decision, so he may be banking some brownie points with the liberals when it makes no difference.

Thank GOD we have Amy Coney Barrett on the Supreme Court! It's hard to believe that four justices, in charge of interpreting the COTUS, ruled the other way on this. Governor Cazzo bans worship services yet allows political protests with hundreds of people to continue.

Justice Neil Gorsuch said it best when he wrote:
“It is time — past time — to make plain that, while the pandemic poses many grave challenges, there is no world in which the Constitution tolerates color-coded executive edicts that reopen liquor stores and bike shops but shutter churches, synagogues, and mosques,”
As we look around the country and the various dictates being issued by leftist Governor's, I wonder how many people realize that this is a look at the totalitarian form of government the "progressives" have in mind for US. I capitalized US because the edicts they lay out aren't for themselves. They're for US, as witnessed by the number of left wing "progressive leaders" that have been caught violating their own orders.

Just like Socialism and Communism, rules, regulations and sacrifice for the common good doesn't apply to the ruling "progressive" class, they are only for We The People.

New York and Chicago were all in with respect to their sanctuary status — until they were hit with the challenge of actually providing sanctuary. In other words, typical liberal hypocrisy.

IF that's he reasoning, he does not deserve a seat on the bench. Supreme Court Justices have ONE job - to uphold the Constitution. Earning political "brownie points" is not part of that job description.

They have a very limited job and deciding cases the way they do is unconstitutional. They are to settle disputes between the branches of government and between the states. Not to run around ruling on what’s legal or every law that comes along in an individual place.

The only person I know who has died from COVID contracted it from a Catholic Church. It was the only place she went during the first wave.

I guess this is one way we will establish herd immunity.

They/them, non-binary and proud.

The right needs to stop worry about what’s between people’s legs. Instead, they should focus on what’s between their ears.

How is it that it is "fairly safe" to stuff 150 people in a fuselage in groups of 6 in a row that's barely 12 feet wide but yet it's "unfathomable" to have 50 people in a 30,000 square foot cathedral or even a 10,000 sq ft contemporary church.

Perhaps that' why the Supreme Court was confused too.

Oh, and that flight might last 3-4 hrs (including wait times at both ends) yet church services RARELY exceed an hour.
