They were having success in winding them down with help from local clergy and other leaders. They believed another 2 days or so and it would have been over.

The tear gas that Mayor Wheeler inhaled was from a canister inside the perimeter fencing erected around the Mark O. Hatfield United States Courthouse and was released by federal law enforcement.

Furthermore, per a city council vote, the Portland Police Bureau are prevented by code to use tear gas unless events are declared a "riot" situation. No riot status was issued, therefore if the PPB released the gas, they would be liable for disciplinary action.
