The Trump on Ballot legal challenge in Colorado goes to court this week.
DENVER — A Colorado judge is weighing whether Donald Trump incited an insurrection and is barred from running for president again. During a hearing this week, she has heard about 19th-century constitutional debates, how and when the National Guard is deployed, free speech rights and jokes cracked by Trump advisers about the Jan. 6, 2021, attack on the U.S. Capitol.

The case, one of many challenging Trump’s ability to serve under an 1868 provision of the Constitution, stands out because the judge overseeing it is holding an unusual week-long trial to help make up her mind. She has heard from constitutional scholars, police officers who were assaulted on Jan. 6, members of Congress and Trump advisers who met with the outgoing president days before the riot.

A Michigan judge ruled Tuesday that former President Donald Trump will remain on the state’s primary ballot, dealing a blow to the effort to stop Trump’s candidacy with a Civil War-era Constitutional clause.

It marks the second time in a week that a state court declined to remove Trump from a primary ballot under the insurrection provision of the 14th Amendment.

The correct decision. Some times the courts get it right. While he should be in jail he also should be on the ballot.

The Michigan Supreme Court ruled Trump can stay on the primary ballot, but he could still go away...
The Michigan Supreme Court on Wednesday gave Donald J. Trump an important victory in the legal battle over his eligibility to return to the White House by allowing the former president to appear on the state’s primary ballot in February.

But in a narrow ruling, the court left the door open for a new challenge to bar Mr. Trump from the general election ballot in the key battleground state over his attempts to overturn the 2020 election.

The decision was the latest in the high-stakes efforts to block Mr. Trump from returning to power. It follows the bombshell ruling by the Colorado Supreme Court, which on Dec. 19 determined in a 4-to-3 opinion that Mr. Trump should be removed from the state’s 2024 Republican primary ballot for his role in the Jan. 6 attack on the U.S. Capitol.

Ron Fein, the legal director of Free Speech For People, which filed the lawsuit seeking to disqualify Mr. Trump, said the Michigan Supreme Court ruled narrowly, sidestepping the core questions at the heart of the case.

But, he noted in a statement, “The Michigan Supreme Court did not rule out that the question of Donald Trump’s disqualification for engaging in insurrection against the U.S. Constitution may be resolved at a later stage.”

Michigan’s primary will be held Feb. 27.

The question of Mr. Trump’s eligibility is widely expected to be answered by the U.S. Supreme Court. Some form of challenge to his eligibility has been lodged in more than 30 states.

I could be higher than the cost of living. Can't shag the feeling the US Supremes will decline to hear it.
Am I wrong thinking more and more, Roberts & Company are reluctant to interfere with the powers of the states reserved or implied to them by the 10th Amendment to the U.S. Constitution.

They just may be happy to leave this in Michigan's lap.
