From All Access: The Media Action Network is asking for the FCC to require the ALEX JONES program be correctly labeled as laid out in FCC guidelines: “If a station airs a disclaimer before the broadcast that clearly characterizes the program as fiction … the program is presumed not to pose foreseeable public harm.”
Commented MAC Director SUE WILSON, "This is not about taking JONES off the air or interfering with his First Amendment rights. This is about licensees' responsibility to the public interest. Individuals in JONES' markets from coast to coast are asking that stations air the appropriate disclaimer, and that the FCC simply enforce its own rule to protect the public from harmful hoaxes."
On the Media Action Network website, they have this list of actual radio stations running Alex Jones, including WAAM in Ann Arbor - which at one time was an All Liberal All The Time format.

I think Alex Jones is despicable, but how is this enforceable? What about the element of time, and proving intent? And how far does this reach? Does the news media similarly have to declare “fact”, and if new info comes out to disprove that content, are they liable?

This isn't about Alex Jones. It is about Freedom of Speech. He's already been taken off of the major digital platforms. But that isn't enough. Some people won't stop until he is utterly destroyed. You're not free to speak by standing on the sidewalk by the White House and declaring you are going to kill the President.
You're not free to speak as an FCC licensed radio station to tell listeners that "$100 is hidden somewhere in Your City USA and all you have to do is find it" or any other "hoax".
Alex Jones claimed among many other things that Sandy Hook school shooting never happened. He stated it as fact, repeating it often and used that "fact" to promote his positions and sell his sponsors products.
So what's the difference between the wacky morning show April Fools Day prank and Alex Jones? This, in my mind, has nothing to do with free speech. If some "liberal" radio show started claiming that Mike Pence was a devil worshipper and isn't really a human, I would think all of you screaming free speech would want to shut that down, wouldn't you?

The exceptions to free speech that you have cited are designed to prevent riots and/or mass panic. What has Alex Jones specifically stated that could lead to or has led to mass panic or riots in the streets?

Tuck your tits back in your pants on First Amendment issues fellas. Being restricted from social media platforms is not a First Amendment issue. They are all private corporations. No one is telling him he can't stand next to a freeway screaming his head off. No one has taken his website down, they are merely choosing not to promote his garbage.
The organization that suggested he be labeled fiction has the same right to free speech as Mr. turd and they have expressed their opinion. The FCC has the ability to restrict speech as our buddy George Carlin pointed out years ago. He is indecent.

In related news: Roger Stone has entered an agreement with Chinese businessman Guo Wengui to retract statements Stone made against Wengui plublished on the Infowars website in lieu of $100M cash settlement.

So it would appear the US District Court for the Southern District of Florida has given it's blessing confirming a frequent Jones/Inforwars contributor trades in false (or might we say works of fiction) narratives.
