Sure, they can, but I doubt they will. This is a great opportunity for Trump to announce that he'll wait until after the election to make an appointment, which will give him a boost with righties for which SCOTUS is a H*** issue. Of course, I would expect they will try and ram a nominee through. I could also argue that RBG should have probably stepped away at the end of the term, given her poor health.
