Ambien does strange things to you, as long as eight hours after taken. I have observed people on Ambien, and even when it should be worn off, they continue to do things like trying to drive when they shouldn't. They are awake, but the things they say and do don't make sense. This was used as a defense of one of the Kennedys a few years ago, and personally, I would say it's a valid and definite possibility. The manufacturers themselves recommend not doing anything requiring full capacity before eight hours. Even though they wake up after three hours. That's my opinion. He probably has a legal prescription for it, which is why it wasn't mentioned.

Completely agree with it!
If it's true he was driving while "doped up" on Ambien, and then got behind the wheel, then he is guilty of driving under the influence of drugs, should have his license suspended, and should face either a fine or jail time.

I talked to my ex-son-in-law who is now a detective about the situation when it first happened.
His take was that because the injured party went to straight to surgery the cops not requesting a blood draw wouldn't be unusual....BUT.....
In Michigan he said the hospital would have done a blood draw for medical reasons and a prosecutor can get those results without need of a warrant under a People vs Perlos case which stated in part....

That case is a Michigan case and doesn't have any implication for California.If after an accident the driver of a vehicle involved in the accident is transported to a medical facility and a sample of the driver's blood is withdrawn at that time for the purpose of medical treatment, the results of a chemical analysis of that sample shall be admissible in a criminal prosecution for a crime described in subsection (1) to show the amount of alcohol or presence of a controlled substance or both in the person's blood at the time alleged, regardless of whether the person had been offered or had refused a chemical test. The medical facility or person performing the chemical analysis shall disclose the results of the analysis to a prosecuting attorney who requests the results for use in a criminal prosecution as provided in this subsection. A medical facility or person disclosing information in compliance with this subsection shall not be civilly or criminally liable for making the disclosure.

Everyone loves "Eldrick", all because at one time he could put a little white ball in a really small hole on a big grass laden area really really well, and he married a beautiful blonde Scandinavian woman, showed us pics of him with his family (and dog), told us how he is first and foremost "a dedicated family man", and after each round of golf when he is in a tournament he would get back to the hotel and call his family and talk for hours, when in truth he lied and was banging porn queens and Waffle House waitresses, then Nov 2009 he was caught , exposed for the fraud of a family man he proclaimed to be, and of course blamed it on other factors..(please Nike and other sponsors don't pull your $$ from me) , suddenly developed nagging back issues, gets caught driving TWICE OWI (or similar), never had to answer to law enforcement, and is basically a jerk. Ignores and berates his fans on the course from past tournaments ("Come on guys watch the cameras"), the most arrogant professional sports personality ever, love watching him lose, just like when the Dallas Cowboys and ND Fighting Irish Football lose...Gentleman Jack always the best Pro Golfer in our lifetime....
