Couple buys home, and a year later the seller still refuses to move out

Post by bmw » Wed Mar 24, 2021 1:40 am

Only in California...
A California couple got more than they bargained for when they discovered a pest in their new home: the former owner, refusing to give up the keys and leave, thanks to a coronavirus eviction loophole.

Tracie and Myles Albert experienced a nightmare after they put down money on a beautiful four-bedroom home in Riverside on Jan. 31, 2020.

More than a year later, the couple is still fighting to move into their home. The previous owner wanted to sell immediately, but has since refused to leave the home, FOX 11 News reported...

This situation sounded fishy from the get-go. Anyone who demands an immediate cash payment in full (on a Sunday no less, when the banks are closed) is suspect. A good realtor would suggest adding an escrow clause to the sale contract. The buyer pays the purchase price to the escrow account. The funds are held in escrow until the seller hands over the keys and vacates the property, giving them incentive to leave. The seller in this case was obviously running a scam to take advantage of a loophole in the law. Shows how poorly-written these laws are. But hey....it's California.

So can the new owners legally move in and co-habitate with the original owner? If so, I'd probably reach a point where that's what I'd do - move in and then make the old owner's life a living hell, trying to accomplish a constructive eviction. You know, blast loud music in the middle of the night, stink up the house to high heaven, etc.

That would be my route. I'd spend a bit of money to find out all about his extended family. And make their lives miserable at home, school and work.

I'm sure most everyone in The Golden State and elsewhere think he's being a bonehead. Share with his family's neighbors and employers that they're related to him.

Always have a realtor involved.

They/them, non-binary and proud.

According to the story they had a realtor. Either the realtor didn't do their due diligence, or the buyers went around them to do the deal.
