Noncompete ban

Unread post by sinklair »

It appears as if the Federal Trade Commission may soon ban the use of noncompete clauses:
https://www.wnem.com/2023/01/05/federal ... e-clauses/

These restrictions are used in nearly all media contracts… especially by Sinclair, Gray and Nexstar stations (not sure about Allen Media, but I wouldn’t be surprised if they did as well).

You can’t tell me that the newest MMJ, photographers or producers have a high level of strategic knowledge that they shouldn’t be allowed to pursue whatever job they want… including across town at a rival TV station.

Maybe this development will finally force station managers to pay better and be more attentive to their staff if they have to worry that they could go to a station across the street.

Maybe some, but highly doubtful companies such as Sinclair (based on what has been said here) will care.

Noncompetes have been pretty useless unless there is compensation ongoing in exchange for staying away from competition. Regular wages are not enough to enforce these agreements.
For Kristian Trumpers are not serving our Lord Christ, but their own appetites. By smooth talk and flattery they deceive the minds of naive people.

Can you imagine someone thinking this will change things in a shit market like Flint/Saginaw? As if most people don't view the market as a passthrough...

Sinclair, Gray, Scripps, Nextar, etc. Will fight it in the courts I think it's a good thing to get rid of the non-compete. Bill Stiffen left WZZM which WZZM didn't put non-compete in the contract and went to WOOD TV the next day in 2001.

Gosh, there oughta be a UNION that everyone must join in order to work in a media outlet. That would protect all the downtrodden and disrespected members of broadcast / media from having to move out of a market in order take a step up in their career.

Better yet, why not ban corporate / private ownership of broadcast altogether? Let only the gummint run the facilities? Make all wages the same - from talking heads to sales to writers, management, and engineers. The increase in operational efficiencies alone would guarantee uniform wages across the board and wipe out the whining about what the owners do with profits - if they have any.

IDK about for other sectors of the workforce (like garbage truck drivers), but for the stink bunch I doubt this FTC action alone will make the world a much better place.

Negotiate your best deal. If you don't like the deal, don't sign it. I don't undersand what's so difficult

Yup. Some people just have unrealistic views on the employer/employee dynamic.
