I think it worth pointing out that the Pence classified documents case was closed out last month with no charges. The Biden one is ongoing. If there were truly a double standard they’d have popped Pence and closed Biden’s out quickly.

Like the former prosecutor said, to take the documents is a mistake and has never been prosecuted. To repeatedly lie and mislead Federal prosecutors is an entirely different situation and that is the one Trump finds himself in.

Here's another fun little tidbit. While the answer to the question of whether Trump could pardon himself if he won the election is one that legal scholars don't agree on, Trump would have an easy way around this: The 25th Amendment:

Section 3

Whenever the President transmits to the President pro tempore of the Senate and the Speaker of the House of Representatives his written declaration that he is unable to discharge the powers and duties of his office, and until he transmits to them a written declaration to the contrary, such powers and duties shall be discharged by the Vice President as Acting President.

Trump simply submits such a written statement to those two individuals, his VP pardons him, then he submits a written statement that he once again is able to perform the duties of President. Major political controversy, but no legal controversy.

Here's the reaction from Trump's own former federal prosecutor Mary McCord, who served as assistant attorney general for national security from 2016 to 2017....

Q: What was your reaction to the indictment?

McCord: The indictment was, frankly, even stronger than I expected, and by stronger I mean the evidence of obstructive conduct — failure to cooperate, failure to return classified information that had been requested, was far more fulsome than even I had imagined and went back much further in time. So my reaction was, first of all, “Wow, Mr. Trump was in this from the beginning.” That whole defense that was floated by his attorneys that in the rush of getting out of the White House, this was all by mistake, and he was cooperative later on — the indictment, if the allegations can be proved, really puts the lie to that.
