I don't know anything about copyright law, but I guess I better be careful playing a CD at a back yard barbecue or at work in the office.

You're safe. Your not making money off it. More than likely the bar didn't get in trouble playing it. They got in trouble because someone recorded patrons singing and dancing to it. That's the threshold to be subject to litigation.

If I was that water hole's counsel, my first step would be for the plaintiff to prove they played the tunes.

Here's ASCAP's "Example" suit to bring others into line. The lawsuit only has teeth because they were already a licensed bar. That license was a binding contract they now have broken. Had they never been licensed, this lawsuit would be much more difficult to win.

This should be fun to watch, but implying usage rights isn't working these days.
